1. These competition rules („Competition Rules”) apply to the competition organised by New Perspective Kft. (address: 8200 Veszprém, Viola u. 2.), as the organiser (hereinafter: „Organiser”) on the Organiser’s Facebook and Instagram pages (https://www.facebook.com/egzoomania/; https://www.instagram.com/egzoomania/) prize draws announced from time to time („Draw”).
2. During the Game, within the timeframe specified in the announcement, on the Organiser’s Facebook and Instagram pages, in response to the questions posted in the Game (https://www.facebook.com/egzoomania/; https://www.instagram.com/egzoomania/) To enter, participants must post the correct answer in the comments section of the published competition post. By submitting their answer, the participant („Player”) acknowledges that they are bound by the Competition Rules. The competition post will appear as a post on the Organiser’s Facebook and Instagram pages, indicating the start and end of the competition (unless this has already been published in advance on the Organiser’s Facebook and Instagram pages). The Organiser’s public posts will contain the questions to be answered, as well as a link to the Rules of the Competition and the Competition’s data protection notice. Any solutions submitted outside the timeframe specified in the Organiser’s Facebook post will not be entered into the Competition. Comments edited by the Player after submission are invalid. During the duration of the Competition, the Player is entitled at any time to delete their comment or to request that the Organiser delete it; however, the deletion of a comment shall be deemed to constitute the Player’s withdrawal of their intention to participate in the Competition.
3. The prize for the Competition is set out in the public announcement (published post) on the Organiser’s Facebook and Instagram pages. The prize is offered and awarded by the Organiser. In the case of a prize package, the Organiser reserves the right to change its contents.
4. Any natural person who has reached the age of 18 and is resident or domiciled in Hungary may take part in the Game in accordance with the provisions of point 2. Persons under the age of 18 but over the age of 14 may also take part in the competition with the consent of their legal representative, provided that, should they be entitled to a prize, it will be collected by their legal representative who is over the age of 18.
5. The following persons are not eligible to take part in the Game:
   
   – the Organiser’s owners, senior officers, employees, agents and their close relatives (Section 8:1(1)(1) of the Civil Code);

– Persons under the age of 14.

6. The Organiser will draw the prize by lot from amongst the Players who have submitted the correct answer, via an electronic system. Those who have given the correct answer to the question for that round (if the Game consists of several rounds) will be included in the draw. The draw will take place within 15 working days of the announcement of the competition. The prize cannot be exchanged for cash or any other prize.
7. The Organiser will draw a number of winners corresponding to the number of prizes, as specified in the Facebook and Instagram posts for the relevant Game. In addition to the winners, a number of reserve winners equal to the number of prizes will also be drawn; these reserve winners will take the place of the winners in the order in which they were drawn, should the winner fail to cooperate with the Organiser in order to receive the prize, (in particular, if they fail to provide the Organiser with the personal data necessary for contact within the deadline specified in clause 8), or are otherwise ineligible to receive the prize for any other reason, e.g. due to a breach of these Rules.
8. The Organiser will announce the winner of the Competition on its Facebook and Instagram pages, stating the name as it appears on the winner’s Facebook and Instagram profiles. The winner consents to the disclosure of this personal data as set out above. The Organiser will notify the winners of the result by replying to the comment containing the correct answer or via a private message, in which the Organiser will ask the winner to send their name, email address and telephone number to the Organiser via a private message on Facebook or Instagram. Winners must reply to the Organiser within 5 (five) days of being notified. If the Winner fails to contact the Organiser within the specified timeframe, the Winner acknowledges that the Organiser is under no obligation to award the Prize, and a reserve winner will take their place, thereby rendering the original Winner ineligible for the Prize.
9. The Organiser shall award the prize to the winner within 30 days of the announcement of the results, by email to the email address provided by the winner. If the winner does not receive the prize within this period, they must notify the Organiser immediately. The winner acknowledges that, in the event of late notification, the Organiser shall not be liable for the availability or delivery of the prize. The rules applicable to the winner shall also apply to the runner-up should they take the winner’s place.
10. By taking part in the Competition and – should they win the Competition – by providing further personal data, the Participant voluntarily consents to the Organiser, as the data controller, processing the personal data provided for the duration of the Competition, and, in the event of a win, until the prize is awarded, in accordance with the provisions set out in the data processing notice annexed to the Rules of the Game.
11. The Organiser accepts no liability for incorrect answers, or for the provision of incorrect or inaccurate names, contact or delivery addresses, or for any delays in notification or delivery. The Player shall bear all consequences arising from any incorrect information provided by them. The Organiser is not in a position to verify the accuracy of the information during (or after) the Game. In this regard, liability and all associated legal and financial consequences shall in all cases rest with the Player. The Organiser accepts no liability for any defects in the prize, unless such exclusion of liability is expressly prohibited by Hungarian law. The Organiser excludes all liability for any claims for damages or compensation arising in connection with participation in the Game, as well as for any costs, damages or losses arising from or relating to any faults in the Game or its organisation, or any costs, damages or losses arising from or related to such errors or shortcomings, except for liability arising from wilful misconduct or a breach of contract causing harm to human life, physical integrity or health. The Organiser accepts no liability if, during the duration of the Game, the Game or the social media platform hosting it is temporarily unavailable for technical reasons.
12. The Game is not affiliated with either Facebook or Instagram, and is in no way sponsored, endorsed or organised by Facebook or Instagram. The https://www.facebook.com/egzoomania/; Facebook page and https://www.instagram.com/egzoomania/ The Organiser is the operator of the Instagram page. Facebook and Instagram (Meta) accept no liability whatsoever arising from or in connection with the Competition.
13. The Organiser reserves the right to amend or supplement these Rules of the Game.
14. The Game is a „promotional” game which does not constitute a prize draw or a game of chance.

3. The purpose of data processing

A https://www.facebook.com/egzoomania/; https://www.instagram.com/egzoomania/ In accordance with the Rules of the Competition, the running of the Competition and the awarding of prizes, as specified in the relevant post on the Organiser’s Facebook and Instagram pages.

4. The legal basis for data processing

The data subject’s consent pursuant to Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council („GDPR”).

With regard to filtering out fraudsters and preventing and countering cyber-attacks (and because individuals who use unauthorised tools (e.g. hacking programmes, viruses, Trojan horses, etc.) or gain an unauthorised advantage through other forms of manipulation, this constitutes the legitimate interest of New Perspective Kft. pursuant to Article 6(1)(f) of the GDPR.

In accordance with the Accounting Act, we process the winner’s data in fulfilment of a legal obligation incumbent on New Perspective Kft, pursuant to Article 6(1)(c) of the GDPR.

5. The scope of the data processed

All personal data provided or disclosed by the data subject that is necessary to achieve the purpose, or that has been provided voluntarily.

For all data subjects: name, Facebook/Instagram ID, and any data to which access is permitted in accordance with Facebook’s and Instagram’s data processing policies and the settings chosen by the data subject.

With regard to the winners: name, telephone number, email address.

6. Recipients of the processed data

The data processor – acting on behalf of the data controller – is the Facebook Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) and the Instagram, LLC The privacy policy and contact details for (1601 Willow Road, Menlo Park, California 94025, United States) are available in Hungarian at https://hu-hu.facebook.com/privacy/explanation.

7. Duration of data processing

For 5 working days following the presentation of prizes to the winners, or until the data subject submits a request for erasure to the data controller. The duration of data processing relating to the winners is eight years, in accordance with Section 169(2) of the Accounting Act.

8. Exercising one’s rights

The data controller shall comply with a data subject’s request to exercise their rights without undue delay following receipt of the request, but within one month at the latest. The date of receipt of the request shall not be included in the time limit. If necessary, taking into account the complexity of the request and the number of requests, the Data Controller may extend the one-month time limit by a further two months. New Perspective Kft. shall inform the data subject of any extension to the time limit within one month of receiving the request, stating the reasons for the delay. You may submit your request to exercise your rights as a data subject, addressed to the Data Controller, in a form suitable for your identification (in order to comply with data security requirements and to adequately protect your rights), to one of the contact details specified in point 1. The Data Controller is obliged to verify that the identity of the data subject matches that of the person wishing to exercise their rights.

9. Your rights regarding the processing of your personal data

9.1. The right of access

The data subject is entitled to request information from the Data Controller, via the contact details provided in point 1, as to whether their personal data is being processed; and, if such processing is taking place, they are entitled to know that

• what personal data the Data Controller holds;
• on what legal grounds;
• for what purpose the data is processed;
• how long it will be processed; and furthermore, that
• to whom the Data Controller,
• when,
• under which legislation,
• to whom you have granted access to your personal data or to whom you have disclosed your personal data;
• the source of the personal data (where the data subject has not provided it to the NAK);
• whether the Data Controller uses automated decision-making, and the logic behind it, including profiling.

In order to ensure compliance with data security requirements and to protect the data subject’s rights, the Data Controller is obliged to verify that the identity of the data subject matches that of the person wishing to exercise their right of access; to this end, access to the information, access to the data and the provision of copies thereof are all subject to the identification of the data subject.

9.2. The right to rectification

You may request, via the contact details provided in point 1, that the Data Controller amend any of your personal data (for example, you may change your registered address or email address at any time). Provided you can credibly verify the accuracy of the corrected data, we will comply with your request within one month at the latest, and the Data Controller will notify you of this in a letter sent to the contact details you have provided.

9.3. The right to have data blocked (restriction of processing)

You may request, via the contact details provided in point 1, that the Data Controller block the processing of your personal data (by clearly indicating the restricted nature of the data processing and ensuring that the data is processed separately from other data) provided that

– disputes the accuracy of their personal data (in which case the Data Controller shall restrict the processing of the personal data to the period required to verify its accuracy);

– the processing of your personal data is unlawful, and you object to the erasure of the data but request, instead, that its use be restricted;

– the data controller no longer needs the personal data for the purposes of processing, but the data subject requires them for the establishment, exercise or defence of legal claims; or

– You have objected to the processing of your data (in which case the restriction applies for as long as it has not been established whether the data controller’s legitimate grounds take precedence over your legitimate grounds).

The data will remain blocked for as long as the reason given by the data subject necessitates the storage of the data.

9.4. The right to object

You may, at any time, object to the processing of your personal data via the contact details provided in point 1, on grounds relating to your particular situation, if you believe that New Perspective Kft. is not processing your personal data appropriately in relation to the purpose set out in this privacy notice. In such a case, the Data Controller must demonstrate that the processing of the personal data is justified by compelling legitimate grounds which take precedence over your interests, rights and freedoms, or which relate to the establishment, exercise or defence of legal claims.

9.5. The right to erasure

The data subject may request the Data Controller in writing, via the contact details provided in point 1, to erase their personal data if any of the following grounds apply:

– the personal data is no longer necessary for the purpose for which it was collected or otherwise processed;

 – the data subject has withdrawn their consent to the processing of their personal data and there is no other legal basis for the processing;

 – personal data has been processed unlawfully;

 – personal data must be erased in order to comply with a legal obligation to which the data controller is subject.

 Personal data may not be erased if it is necessary to process it for the following reasons:

– for the purposes of complying with a legal obligation to which the data controller is subject in relation to the processing of personal data, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller;

– to bring, enforce or defend legal claims.

The data subject has the right to withdraw their consent at any time. The withdrawal of consent does not affect the lawfulness of any data processing carried out on the basis of that consent prior to the withdrawal. Should you withdraw your consent, we shall immediately erase any personal data processed on the basis of your consent; however, in this case, you will no longer be entitled to take part in the competition and will therefore be excluded from it. The data subject is also entitled to delete their Facebook and/or Instagram profile or posts; if this takes place prior to the prize being awarded, the Player or Winner will be excluded from the Game.

9.6. Right to data portability

The data subject is entitled to request, via the contact details set out in point 1, that the Data Controller provide them with the data relating to them that they have made available to the Data Controller, in a widely used, machine-readable format, to be sent to them (or to another data controller designated by the data subject), provided that the legal basis for the data processing is voluntary consent, the conclusion of a contract, the performance of a contract, and the processing is carried out by automated means.

10. Right to a legal remedy

If you consider that the Data Controller has breached the applicable data protection requirements in the processing of your personal data, then

– you may lodge a complaint with the National Authority for Data Protection and Freedom of Information (address: 1055 Budapest, Falk Miksa utca 9–11; postal address: 1363 Budapest, PO Box 9. Email: ugyfelszolgalat@naih.hu, website: www.naih.hu), or

– you have the right to apply to a court to protect your personal data; the court will deal with the matter as a matter of urgency. In this case, you are free to decide whether to lodge your claim with the court having jurisdiction over your place of residence (permanent address) or your place of stay (temporary address), or the court having jurisdiction over the Data Controller’s registered office. You can find the court with jurisdiction based on your place of residence or current address at http://birosag.hu/ugyfelkapcsolati-portal/birosag-kereso. The Budapest Metropolitan Court has jurisdiction over the proceedings based on the Data Controller’s registered office.

11. Terms

The terms used in this information notice have the meanings assigned to them under the GDPR.
